Interpretation

The words with capitalized initial letters have meanings defined under the following conditions. These definitions apply whether the terms appear in singular or plural.

Health Disclaimer

By participating in our programs, you confirm that:

  • You are voluntarily engaging in physical activity.
  • You are in good health and aware of no medical condition that would prevent safe participation.
  • You will consult your doctor before beginning any new fitness or nutrition program, particularly if pregnant, injured, or living with a medical condition.
Assumption of Risk & Waiver of Liability

You acknowledge and agree that:

  • Participation is at your own risk.
  • Fitness Sage, its coaches, employees, contractors, and affiliates are not liable for injuries, illness, or damages that result from use of our services.
  • You voluntarily release and waive any and all claims against Fitness Sage related to your participation.
Eligibility

To register and use the Service, you must be at least 18 years old or have the permission of a parent or guardian.

Payments and Refund Policy
  • All payments for programs and challenges are final and non-refundable, unless otherwise stated.
  • You will receive access to digital content upon payment.
  • Fitness Sage reserves the right to cancel or reschedule programs. In such cases, a refund or credit may be offered at our discretion.
Intellectual Property

All materials provided—including videos, PDFs, branding, workouts, and other content—are the exclusive property of Fitness Sage.
You may not reproduce, distribute, modify, resell, or share this content without our prior written consent.

Community Guidelines

By using our services, you agree to:

  • Treat staff, coaches, and other participants with respect
  • Avoid offensive, discriminatory, or abusive behavior
  • Comply with all program and platform rules

Violation may result in removal from the program without refund.

Our Service may contain links to third-party websites. We do not control or assume responsibility for the content, privacy policies, or practices of any third-party sites.

Termination

We may suspend or terminate your access to the Service without prior notice if you violate these Terms.

Limitation of Liability

To the maximum extent permitted by law, Fitness Sage and its suppliers shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to:

  • Loss of data or profits
  • Business interruption
  • Health issues arising from participation

Our liability shall not exceed the amount actually paid by You or R1,800 (or $100 USD) if no purchase was made.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. Fitness Sage disclaims all warranties, including:

  • Implied warranties of merchantability and fitness for a particular purpose
  • That the Service will be uninterrupted, error-free, or virus-free
  • That the content will meet your expectations or achieve specific results
Governing Law

These Terms are governed by the laws of South Africa. You agree to submit to the jurisdiction of South African courts for any disputes.

Dispute Resolution

If you have any issues or complaints, please contact us first to attempt informal resolution. We aim to resolve all concerns amicably and efficiently.

International Users

If you are located in the European Union, you may be entitled to certain protections under applicable consumer law. These Terms do not affect your statutory rights.

United States Legal Compliance

By using our Service, you confirm that:

  • You are not located in a country under U.S. embargo or designated as a “terrorist supporting” country.
  • You are not listed on any U.S. government prohibited party list.
Severability and Waiver
